The Services include access to Genolife’s public website, the Genolife mobile app, and personal genotyping services, including the collection and analysis of your saliva sample. Unless explicitly stated otherwise, any new feature that expands or enhances the current Service will be subject to the Terms of Service. You acknowledge and agree that the Services are provided and based on the current state of genetic research technology and the technology used by Genolife at the time of purchase. As research progresses and scientific knowledge and technology evolve, Genolife will continually innovate to provide the best possible experience for its users.
You acknowledge and agree that the form and nature of the Services offered by Genolife may change from time to time without prior notice. As part of this ongoing innovation, you acknowledge and agree that Genolife may suspend (permanently or temporarily) certain Services (or any features within the Services) for you or for users in general, at Genolife’s sole discretion and without prior notice. You may stop using the Services at any time. You do not need to specifically notify Genolife when you stop using the Services unless you are requesting the closure of your account. Genolife assumes no liability for the use of the Services outside the terms of these Terms of Service or other applicable terms. To use the Services, you must have Internet access—either directly or through devices that access web-based content and mobile applications—and pay any service fees associated with such access. You are solely responsible for paying such bills. In addition, you must provide all equipment necessary to establish such an Internet connection, including a computer, a modem, or other access device. You are solely responsible for providing such equipment. You acknowledge and agree that, although Genolife may not have set a maximum limit on the number of transmissions you may send or receive through the Services, such maximum limits may be set by Genolife at any time.
Once you receive your genetic information, that knowledge is irrevocable. You should not assume that any information we may provide you will be positive. You should also understand that as research progresses, you may need to seek additional services from Genolife, your doctor, a genetic counselor, or another healthcare provider in order to evaluate the significance of your DNA in the context of those advances. We encourage you to speak with a genetic counselor or a healthcare professional with special training in genetic conditions before collecting the sample for testing, in order to obtain more information so that you can make an informed decision about whether the tests are right for you.
A genetic counselor can also help you understand your results and options. Some people feel a little anxious when receiving genetic health test results. This is normal. If you feel very anxious, you should talk to your doctor or a genetic counselor before having your sample collected for the test. You may learn things about yourself that you didn’t expect. This information can evoke strong emotions and may even alter your life and worldview. You may discover things about yourself that concern you and that you may not be able to control or change (for example, your father is not genetically your father, surprising information related to your ancestry, or that someone with your genotype may have a higher risk of developing a specific condition or disease). These results could have social, legal, or financial implications. You should not change your health-related behavior based solely on information from Genolife. Be sure to discuss your genetic information with a doctor or other healthcare professional before taking any action based on genetic information provided by Genolife’s services. For the most common diseases, the genes we know of account for only a small fraction of the risk. There may be unknown genes, environmental factors, or lifestyle factors that are much more significant predictors. If your data indicate that you do not have a high genetic risk for a particular disease or condition, you should not assume that you are protected.
Conversely, if your results indicate that you have a high genetic risk for a particular disease or condition, this does not mean that you will definitely develop that disease or condition. In any case, if you have concerns or questions about what you learn through Genolife, you should contact your doctor or another healthcare professional. Please note that genetic risk assessment does not apply to carrier screening test results. Genetic research is not exhaustive. Although we analyze hundreds of thousands of data points from your DNA, only a small percentage of them are related to human traits or health conditions. The scientific community is learning more about genetics, and an important mission of Genolife is to conduct and contribute to this research. Furthermore, many ethnic groups are not included in genetic studies. Because the interpretations provided by our service are based on these published studies, some interpretations may not apply to you. Future scientific research may change the interpretation of your DNA.
In the future, the scientific community may be able to present research that is currently incomplete or inaccurate, and the genetic information you share with third parties could be used against your interests. You should be careful about sharing your genetic information with third parties. Currently, very few companies or insurance providers request genetic information, but this could change in the future. You may want to consult an attorney to understand the scope of legal protection for your genetic information before sharing it with any third party. furthermore, the genetic information you choose to share with your doctor or another healthcare professional may become part of your medical record and, through that channel, may be accessible to other healthcare professionals and/or insurance companies in the future. Genetic information you share with family, friends, or employees could be used against your interests. Even if you share genetic information that has no significance or only limited significance, that information could become significant in the future as new discoveries are made. If an insurance company asks you whether you have obtained genetic information about your health and you fail to disclose it, this could be considered fraud. Genolife’s services are for research, informational, and educational purposes only. We do not provide medical advice. The genetic information provided by Genolife is for research, informational, and educational purposes only.

First, many of the genetic findings we develop have not been clinically validated, and the technology we use is the same technology used by the scientific and genetic community, which to date has not been used for clinical trials. The disclosure of individual-level genetic and/or self-reported information to third parties will not occur without your explicit consent, unless required by law. Please note that Genolife cannot control any further disclosure of genetic and/or self-reported information that you share publicly on the Genolife website and mobile app. You acknowledge and agree that you are responsible for protecting and enforcing those rights and that Genolife has no obligation to do so on your behalf. Once your saliva sample is submitted and analyzed, it is processed irreversibly and cannot be returned to you. Visit our website for more information about sample processing. Any genetic information derived from your saliva will remain your information, subject to the rights we retain as set forth in these Terms of Service. You acknowledge that you should not expect any financial benefit from Genolife as a result of the processing of your genetic information, as provided in our Privacy Policy and Terms of Service, Waiver of Property Rights. As stated above, you understand that by providing any sample, having your genetic information processed and accessed, or providing self-reported information, you do not acquire any rights to any research or commercial product that Genolife or its collaborators may develop. You understand that you will not receive compensation for any commercial or research product that includes or results from your Genetic Information or Self-Reported Information.
You agree to defend and hold harmless Genolife, its subsidiaries, affiliates, officers, agents, contractors, partners, employees, successors, and assigns from any claim or lawsuit, including reasonable attorneys’ fees and expenses incurred by any third party arising out of the User Content. If you have submitted a saliva sample or provided your own Genetic Information, you will defend and hold harmless Genolife, its employees, contractors, successors, and assigns from any liability arising from the use or disclosure of any information obtained from the genotype of your saliva sample. Furthermore, if you choose to provide your Genetic and/or Self-Reported Information to third parties—whether to individuals to whom access is intentionally granted or to third parties for diagnostic or other purposes— you agree to defend and hold harmless Genolife, its employees, contractors, successors, and assigns from any liability arising from such disclosure or use of your Genetic and/or Self-Reported Information.
Unless the terms of the Limited License in Section 9 of these CDS are met, or unless otherwise agreed upon in a separate agreement between you and Genolife, you agree not to display, distribute, authorize, perform, publish, reproduce, duplicate, copy, create derivative works from, modify, sell, resell, exploit, transfer, or transmit for commercial purposes, in whole or in part, the Service or the access to the Service provided by Genolife.
You acknowledge that Genolife may establish general practices and limits regarding the use of the Services, including, but not limited to, the maximum number of days that the Service will retain Personal Information, the maximum disk space that will be allocated to Genolife’s servers, and the maximum number of times the Services may be accessed within a given period of time. You acknowledge and agree that Genolife bears no responsibility or liability for the deletion of messages, communications, or other content maintained or transmitted through the Services; nor does it bear any responsibility or liability for the loss of genetic information due to the malfunction or destruction of data servers or other catastrophic events. Furthermore, you acknowledge that Genolife reserves the right to change these general practices.
Genolife reserves the right to modify or discontinue the Services, temporarily or permanently, at any time, with or without prior notice. You acknowledge and agree that
(a) the changes may result in a delay in the calculations performed by some of Genolife's functions or services, and
(b) Genolife shall not be liable to you or to any third party for any modification, suspension, or interruption of the Services.
The software you use may occasionally automatically download and install Genolife updates. These updates are designed to improve and further develop the Services and may include bug fixes, enhanced features, new software modules, and entirely new versions. You agree to receive such updates (and to allow Genolife to deliver them to you) as part of your use of the Services.
The CDS will remain in effect until you or Genolife terminate the agreement as set forth in this Section. If you wish to terminate your legal agreement with Genolife, you may do so by notifying Genolife in writing, which will result in the closure of your accounts for all Services you use. Your notice must be sent to Genolife’s address, which is listed at the beginning of the Terms of Service, or online through Customer Service. If you provide notice online, Genolife will send you an email asking you to confirm your request, and the termination will take effect upon receipt of a second confirmation email from you. Genolife may terminate its legal agreement with you (along with your password and account) at any time if:
Any suspected fraudulent, abusive, or illegal activity that may constitute grounds for termination of your use of the Services may be referred to the appropriate law enforcement authorities. You acknowledge and agree that Genolife shall not be liable to you or any third party for the termination of your access to the Services.
Upon termination of the CDS, all legal rights and obligations from which you and Genolife have benefited (or that have accrued over time while the CDS were in effect) or that are intended to continue indefinitely shall not be affected by such termination, and the provisions of the following sections:

Furthermore, you acknowledge and agree that Genolife shall not be liable, directly or indirectly, for any damage or loss caused or allegedly caused in connection with the use of or reliance on such content, goods, or services available through any hyperlinked site or resource.
You acknowledge and agree that Genolife (or Genolife’s licensees, as applicable) owns all legal rights, title, and interest in and to the Services, including: the intellectual property rights in the Services (whether registered or unregistered, and in any part of the world where such rights exist). Furthermore, you acknowledge that the Services may contain information that Genolife has designated as confidential and that you must not disclose such information without Genolife’s prior written consent. Furthermore, you acknowledge and agree that the Services and any software necessary in connection with the services provided (“Software”) contain confidential information that is protected by applicable intellectual property rights. Furthermore, you acknowledge and agree that the information presented to you through the Services or by sponsors is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly authorized by Genolife, you agree not to modify, rent, lease, lend, sell, distribute, create derivative works, reverse engineer, decompile, or attempt to extract the source code of the Services or Software. The Software, if applicable, will be available for download from the Services. Unless Genolife has expressly authorized you in writing, you agree that, when using the Services, you will not use any trademark, service mark, trade name, or logo of any company or organization in a manner that is likely to cause confusion with Genolife or with the intent to do so. For any Software not accompanied by a License Agreement, Genolife grants you a personal, non-transferable, and non-exclusive right and license to use the object code of its Software on a single computer or mobile device. You may not copy, modify, create a derivative work, reverse engineer, disassemble, or attempt to discover any source code, sell, assign, sublicense, grant a security interest in, or transfer any rights in the Software unless this is expressly permitted or required by law, or unless Genolife has specifically instructed you in writing to do so. This license is intended solely to allow you to use and enjoy the Services as provided by Genolife, in the manner permitted by the Terms of Service. Unless Genolife has granted you specific written permission to do so, you may not assign or sublicense your rights to use the Software, or transfer any part of your rights to use the Software. You agree not to access the Service by any means other than through the interface provided by Genolife. All rights not expressly granted herein are reserved.
To the extent permitted by applicable law, you expressly acknowledge that Genolife shall not be liable for any direct, indirect, incidental, special, or consequential damages, including, but not limited to, damages for loss of profits, payment, use, data, or other intangible losses (even if Genolife has been advised of the possibility of such damages) (examples):
Notifications may be sent via email or regular mail. Genolife may also provide notices of changes to the CDS or other matters by displaying notices or links generally throughout the Services. If you violate the terms of these Terms of Service and/or if Genolife reasonably suspects that you have violated the terms of these Terms of Service, Genolife shall have the right to suspend or terminate your account, and may refuse to allow you to use the services (or any part thereof) in the future.
Genolife (Información de Vida S.A.P.I. de CV.) reserves the right to make changes or updates to this CDS at any time to address new legislation, internal company policies, or new requirements for the provision or offering of its services.
