We hereby provide you with the following Privacy Notice, as detailed below, in compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter the “Law”) and as provided in its Rules of Procedure (hereinafter “The Regulations”).
The Person in Charge refers to its employees, contractors, customers, suppliers, or providers of goods and/or services, all of whom are individuals and legal entities (hereinafter “The Headliner”), the following categories of personal data: identification data (such as name, age, nationality, gender, etc.), financial data, employment data, home address, billing information, credit and/or debit card numbers and/or promotional codes, phone numbers, email addresses, special requests, corporate data, legal representation data, official identification, security video recordings, and the company’s or business’s line of business.
The personal data listed above may be obtained from the Data Subject (i) in person; (ii) directly, either electronically or through requests, questionnaires, or forms; (iii) indirectly through publicly available sources or from third parties authorized by the Person in Charge, which are collected and generated from the legal relationship established with the Data Subject.
The personal data that The Person in Charge These are intended for two types of purposes, as described below:
1.1.- Those that give rise to a legal relationship between The Person in Charge y The Headline, and are necessary for the existence, maintenance, and fulfillment of that legal relationship:
- In the case of suppliers or providers of goods and/or services, for the purpose of fulfilling the obligations arising from the service agreement entered into between The Headline y The Person in Charge, which are set forth in the respective civil or commercial contracts;
- Identify The Headline when you enter and remain on the premises of the Data Controller; and
- In general, for all purposes related to the contractual or any other type of legal relationship entered into between The Person in Charge y The Headline (such as billing information, charging credit and/or debit cards for services provided by The Person in Charge, quality and satisfaction assessments and surveys regarding goods and services, data collected through the Genolife mobile app (Genolife App), etc.,)
1.2.- Purposes that are neither necessary nor give rise to a legal relationship with The Person in Charge, such as: Advertising of goods and/or services related to The Person in Charge, or any matter related to a commercial inquiry.
1.3.- For the purposes of genetic analysis, since genetic information is required from The Headline When preparing reports that are delivered electronically (such as via WhatsApp, email, and/or the Genolife app) or as a printed hard copy, it is important to note that the genetic information obtained from a buccal swab sample, saliva, whole blood, and/or any other human secretion, is analyzed using proprietary algorithms developed by The Person in Charge in order to obtain the result that is delivered to The Headline. This result is stored on servers at The Person in Charge for internal control and possible revisions to results in order to update reports based on new literature evidence that was not available at the time the results were compiled.
The Person in Charge agrees not to transfer your personal information to third parties, whether individuals or entities, without your consent, except:
- In the case of Mexican or foreign individuals who are subsidiaries, affiliates, or dependents of The Person in Charge, since data transfers are essential for maintaining and fulfilling the legal relationships listed in section 1.1 of the subsection titled PROCESSING AND PURPOSE OF THE DATA SUBJECT'S PERSONAL DATA.
- The exceptions provided for in Article 37 of the Federal Law on the Protection of Personal Data Held by Private Parties, as well as the requirement to carry out this transfer in accordance with the terms established by said Law.
- Mexican and foreign financial authorities, for the purpose of complying with their obligations from the Data Controller arising from international laws or treaties as a financial institution, tax obligations, as well as to comply with official notices or requests.
- Mexican and foreign judicial authorities, for the purpose of complying with official notifications, requests, or letters
- IMSS (Mexican Social Security Institute) or any social security authority, for the purpose of complying with the obligations set forth in current social security legislation.
- If any transfer of the Data Subject’s personal data is made that requires the Data Subject’s express consent, such consent will be requested.
The Data Subject has the right to access their personal data held by the organization The Person in Charge, as well as to correct them if they are inaccurate or incomplete; to have them deleted when you consider that they are no longer required for any of the purposes set forth in this Privacy Notice, as well as when they are being used for purposes for which you have not given consent or when the contractual or service relationship has ended; or to object to the processing of such data for specific purposes (hereinafter, the “ARCO Rights”).
This applies to the data collected, as specified in the paragraph 1.1 of this Privacy Notice.
The mechanisms implemented for the “ARCO Rights“, are exercised by submitting the corresponding application form provided by The Responsible One at the following link, which must be filled out by The Headline:

Response Timeframe: The maximum timeframe for receiving a response to the Data Subject’s request is 20 (twenty) business days, counted from the day the request is received, so that, if the request is granted, it may be carried out within fifteen days following the date on which the response is communicated.
In the case of requests for access to personal data, the information will be provided upon verification that the requester is The Account Holder or Legal Representative with full authority, as appropriate.
The deadlines mentioned above may be extended by The Person in Charge on a one-time basis for an equal period, provided that the circumstances of the case warrant it.
The exercise of ARCO rights is free, and the subscriber will only be responsible for covering, if applicable, the costs of reproduction or shipping.

The Data Subject also has the right to initiate a Data Protection Procedure with the Federal Institute for Access to Information and Data Protection, which can be accessed at https://home.inai.org.mx/. You have certain rights regarding your Personal Data. This means that you can:

Delete or correct your Personal Data as well as your Genetic Data. The easiest way to update your account information is through the app's settings, while to delete or correct your genetic data, you must submit a request through the ARCO Form. Request that we stop processing your Personal Data—including for promotional and direct marketing purposes, such as rewards, promotions, and other types of personalized offers—by sending an email to info@genolifeadn.com. However, please note that we may occasionally need to use your Personal Data in order to provide you with the Services).
Request that we transfer your Personal or Genetic Data to another organization (to the extent that it is technically feasible).
File a complaint with a regulatory authority. In this regard, we would appreciate it if you would first contact us to share your concerns directly with us and give us the opportunity to resolve them.
The law provides for exceptions to these rights under certain circumstances. If you are unable to exercise any of these rights due to such an exception, we will explain the reason.
We offer you a number of choices regarding the collection, use, and disclosure of your Personal Data, and we will respect the choices you make. Please note that if you choose not to provide us with the Personal Data we request, you may not be able to access all features of the Services.
Our goal is to provide you with the information or achieve the result you have requested within 20 (twenty) business days, or within the shortest time period established by the laws of that jurisdiction.
The Person in Charge reserves the right to make changes or updates to this Privacy Notice at any time to address new legislation, internal company policies, or new requirements for the provision or offering of its contracting services.
